Brazil Permanent Residency: Every Route to an Indefinite Stay, and What Comes After
Written by Gabriela Rabachini, Brazilian attorney, OAB/SC 78438. Official sources checked November 3, 2026. Updated November 3, 2026.
What "permanent" means in Brazil now
Brazil's 2017 Migration Law replaced the old "permanent visa" with residence authorizations, granted either for a fixed term or por prazo indeterminado, for an indefinite term. When people search for Brazilian permanent residency, the indefinite-term residence is what they are looking for. It still has conditions, and it can be lost.
This page maps the routes that reach it for an American without a Brazilian employer, as written in the official texts on November 3, 2026. It is general information, not an assessment of anyone's eligibility. For the whole move in order, start at the hub: Moving to Brazil from the US.

Investing in a Brazilian company: indefinite from the start
Resolution 13/2017, as amended in 2024, covers an individual who invests their own funds of foreign origin in a Brazilian company, in a project with potential to create jobs or income. The minimum is the equivalent of R$500,000 with an investment or business plan, or from R$150,000 for innovation or research projects that meet specific conditions. The residence is for an indefinite term, and keeping it depends on proving that the plan is being carried out.
Real estate: four years, then indefinite
Under Resolution 36/2018, your own foreign-origin funds go into urban property worth at least R$1,000,000 (or R$700,000 in the North and Northeast). The residence lasts 4 years. After that it may be changed to an indefinite term if the investment is maintained, with a copy of your CRNM card and criminal record certificates (art. 5). Throughout, you must be in Brazil at least 14 days in each two-year period (art. 6). The full rule is in Brazil's Real Estate Residency.
Family reunion: it follows the sponsor, and then stands alone
The regulation grants family reunion to spouses and partners, children, parents of a Brazilian child and other relatives (art. 153). Two provisions lead to an indefinite term:
- The sponsor's term carries over. When the sponsor's residence is for an indefinite term, the family member's is too (§4). When the sponsor's has an end date, the family member's ends on the same date (§5), and Portaria Interministerial 3/2018 has a Federal Police procedure for changing a family residence to an indefinite term once the sponsor's has changed (Annex VIII).
- After four years, a residence of your own. Someone who held residence based on family reunion can get a new, indefinite-term residence after living in Brazil at least 4 years, proving means of support and presenting a clean criminal record (art. 160). This does not apply where the original family link was fraudulent.
For a spouse of a Brazilian citizen, the texts we read do not state the length of the first residence. See Brazil Spouse Visa for what they do say, and Having a Baby in Brazil as a Foreigner for parents of a Brazilian child.
Retirement: two years, then a choice for the authority
Resolution 40/2019 grants up to two years. Resolution 41/2019 added to Resolution 30/2018 the documents for both a renewal and a change to an indefinite term for retirees: proof that you are still retired or a survivor's pensioner with the US$2,000 monthly transfer capacity, and for the indefinite term, the processing fee receipt. Resolution 30 says the authority "may" renew for up to two years or change the term to indefinite (art. 1). More in Brazil Retirement Visa.
Work-based residence in general
For several purposes, including work, the regulation grants an initial term of up to two years, after which the granting authority may, on request, renew it for up to two years or change it to an indefinite term (Decreto 9.199, art. 142, §§2 and 3). Resolution 30/2018 lists the documents for each CNIg resolution that can take that step.
The digital nomad: no path
Resolution 45/2021 allows the residence to be renewed for an equal period (art. 6) and contains no change to an indefinite term. Resolution 30/2018, which lists the conversions, predates it. To stay longer, a nomad requests residence on a different basis; asking for a new basis means giving up the previous status, and asking after it expired brings an overstay fine (Decreto 9.199, art. 130).
Less common bases
The regulation also allows an indefinite-term residence for, among others, a person who once held Brazilian nationality and does not wish to or cannot reacquire it (art. 155, §2), and for recognized refugees, asylees and stateless persons (art. 156, §2).
Living with an indefinite-term residence
The card still expires
An indefinite-term residence does not mean an indefinite card. The CRNM is valid for nine years from registration, and has no expiry date if the holder had turned 60 by the date it would expire, or is a person with a disability (Decreto 9.199, art. 74). Renewing a card classified as permanent is a Federal Police service with the R$204.77 card fee.
How it can be lost
The regulation declares the loss of a residence authorization when (art. 135):
- the basis on which it was granted ends (for example, the investment is undone);
- you obtain a residence on another basis; or
- you are absent from Brazil for more than two years without justification.
You must tell the Federal Police when you stop meeting the conditions of your residence (art. 135, §1), and losing one basis does not stop you from applying on another (§2). A residence is cancelled at any time for fraud or concealed impediments (art. 136).
From residence to citizenship
The Migration Law sets four conditions for ordinary naturalization (art. 65): civil capacity, 4 years of residence, the ability to communicate in Portuguese, and no criminal conviction (or rehabilitation). The four years drop to one year for someone with a Brazilian child, or a Brazilian spouse or partner they are not separated from (art. 66).
The regulation adds the details that trip people up:
- Only indefinite-term residence counts toward the residence periods (Decreto 9.199, art. 221). Years on a temporary residence, such as the four real estate years or the nomad years, do not.
- The period must come immediately before the application (art. 233, §1).
- Trips abroad that total no more than 12 months do not prevent ordinary naturalization (art. 233, §2).
- Owning property is not proof of residence; actual residence must be shown (art. 233, §3).
Separately, the Constitution provides for naturalization of foreigners resident in Brazil for more than 15 uninterrupted years without a criminal conviction, if they request it (art. 12, II, b).
Myths checked against the text
- "Buying property gives you permanent residency." Resolution 36 grants 4 years first, then an indefinite term if the investment is kept. Owning property is also not, by itself, proof of residence for naturalization.
- "The nomad visa converts to permanent residence after two years." Resolution 45 has no such provision.
- "Permanent means you can live abroad as long as you like." More than two years away without justification is a ground for loss.
- "All your years in Brazil count toward citizenship." Only years on an indefinite-term residence count.

Common questions
Does Brazil still have a permanent visa?
Not under that name. Since the 2017 Migration Law, the long-term status is a residence authorization for an indefinite term (prazo indeterminado). It is what people usually mean by permanent residency.
What is the fastest route to permanent residency for an American?
It depends on your situation, and no route is automatic. Investment in a Brazilian company under Resolution 13/2017 is granted for an indefinite term from the start. Family reunion with someone who already holds an indefinite-term residence is also indefinite. Real estate under Resolution 36 is 4 years first.
Does the digital nomad visa lead to permanent residency?
No. Resolution 45/2021 allows renewal for an equal period and contains no change to an indefinite term. A longer stay means requesting residence on a different basis.
Can I lose permanent residency in Brazil?
Yes. The regulation lists the end of the basis of the residence, a new residence on another basis, and absence from Brazil for more than two years without justification (Decreto 9.199, art. 135).
How long until I can become a Brazilian citizen?
Ordinary naturalization needs 4 years of residence, reduced to 1 year with a Brazilian child or a Brazilian spouse or partner. Only periods of indefinite-term residence count (Decreto 9.199, art. 221).
